Pen Argyl Borough Monthly Minutes

Tuesday 7th of February 2017 - Council Meeting Minutes

            Pen Argyl Borough Council held their Meeting for February on Tuesday, February 7, 2017

at 7:00 P. M. in the Fire Hall.

 

Pledge of Allegiance:

                Council Vice President Dean Minnich opened the Council Meeting with the Pledge of Allegiance.

 

Roll Call:

                Council Members present and responding to roll call were:  Angelo Uliana, Joseph LeDonne, Charles Kandl Jr., Roberta Cowley, Dean Minnich and Robert O'Donnell.  Council President Michael Nasatka and Councilman Jan Surotchak were absent.

 

                Also present were Mayor Mikal Sabatine, Borough Solicitor Peter Layman and Borough Manager Robin Zmoda.

 

Visitors:

Representatives from Blue Mountain Community Library were present:  Judy Piper, Treasurer; Valerie Viglione, President; Joanne Pavan, Vice President and Lisa Farnan, Manager.  Judy Piper gave a copy of the library’s 2016 report as well as reviewed it with Council.

 

                Tom Lee, 14 B Street and Tom Carlo, 306 S. Robinson Avenue spoke to Council regarding the proposed Synagro biosolid processing plant in Plainfield Township.  They were concerned with odors coming from the proposed plant, health concerns and property values. 

 

                Councilman Charles Kandl Jr. made a motion to draft a letter to the Plainfield Township Planning Commission, copying the Township Supervisors, Green Knight Economic Development Corporation, Waste Management and Synagro that Pen Argyl Borough Council disapproves of the biosolids recycling facility due to its potential impact on the residents of Pen Argyl and the Slate Belt Region, seconded by Councilman Robert O’Donnell.  Unanimous vote by roll call. 

 

Public Works Report:

 

All Council Members were given a copy of Public Works Director Steven Bender's January report to review. 

 

Councilman Charles Kandl Jr. made a motion to advertise for bids for the B Street construction project, seconded by Councilman Joseph LeDonne.  Unanimous by vote roll call.

 

Councilman Angelo Uliana made a motion to advertise for bids for the Delabole Junction stormwater improvements, seconded by Councilman Charles Kandl Jr. Unanimous by vote roll call.

 

Councilwoman Roberta Cowley made a motion to advertise for the Carousel façade project, seconded by Councilman Joseph LeDonne. Unanimous by vote roll call.

 

                Borough Manager Robin Zmoda informed Council she will be moving forward to apply for a MS4 Waiver for the Borough.

 

                Zmoda also informed Council that she had received the Notice to Proceed from the Department of Conservation and Natural Resources (DCNR) for the Weona Park Master Site Plan Update.  She will be contacting Urban Research and Development Corporation (URDC) to begin the project.  The Master Site Plan Committee will be receiving information on the kick off meeting.


Zoning Report:

 

                All Council Members were given a copy of Zoning/Codes Office's January report to review.

 

                Zmoda presented information on Medical Marijuana Zoning issues and concerns.  Presently no applicants have contacted the Borough.  The Borough will need to monitor the situation and decide if present zoning is acceptable or if there needs to be a change. 

 

                Council was given the notice regarding the Zoning Hearing on St. Elizabeth Church’s application to build a school at 300 W. Babbitt Avenue.

 

                Council was given information regarding the wireless industry attempt to strip municipalities of the right to control the construction and location of wireless facilities in the public rights of way and effectively eliminate the right of municipalities to assess fees for such facilities.  Councilman Robert O’Donnell made a motion to send a letter to our legislators opposing the “Wireless Infrastructure Deployment Act,” seconded by Councilman Charles Kandl Jr.  Unanimous vote by roll call. 

 

Police Report:

 

                Council was given a copy of the December 2016 Regional Police report.

 

Fire Chief's Report:

 

                Fire Chief Dean Parsons reported that the fire company received eight (8) calls for the month of January.  They spend 194 hours on drills and 201 hours on calls.

 

Minutes:

 

                Councilwoman Roberta Cowley made a motion to approve the Minutes for Regular Council Meeting of Tuesday, January 3, 2017, seconded by Councilman Charles Kandl Jr.  Unanimous vote by roll call. 

 

                Council was also given copies of the February 1, 2017 Slate Belt Chamber’s Economic Development Committee meeting and the Slate Belt COG January 24, 2017 meeting.

 

Correspondence:

 

                Council received correspondence thanking them for their yearly contribution from the Salvation Army.

               

                Council was also given correspondence from Northampton County’s Outstanding Senior Award, the Heritage Center, Ralph Behler Memorial Golf Classic, Slate Belt Chamber Enterprise week and Pennsylvania Audubon.

               

Mayor's Report:

 

                Mayor Mikal Sabatine reported Officer Shawn Moskella was promoted to Sergeant for the Slate Belt Regional Police Department.  

 

Planning Commission:

                Nothing to report.

 

Solicitor's Report:

                Borough Solicitor Layman requested an executive session before Council adjourned to discuss real estate and potential litigation.

 

Sanitation, Solid Waste & Recycling:

                Council Members were given a copy of the Wastewater Treatment Plant’s January report.

 

                Councilman Angelo Uliana made a motion to advertise for bids for sludge disposal, seconded by Councilman Joseph LeDonne.  Unanimous by roll call vote.

 

Finance, Tax Exoneration, Insurance & Personnel:

                All Council Members were given a copy of the Treasury Report as prepared and submitted by Borough Manager/Treasurer Zmoda.  Councilwoman Roberta Cowley made a motion to accept the Treasury Report as prepared, seconded by Councilman Angelo Uliana.  Unanimous by roll call vote.

 

                 Council reviewed the list of delinquent 2016 delinquent Borough Real Estate Taxes as submitted by Tax Collector Michael Zavacky.  Councilman Charles Kandl Jr made a motion to turn the list of delinquent 2016 Borough Real Estates Taxes over to the County for collection, seconded by Councilman Angelo Uliana.  Unanimous vote by roll call.

 

                A list of the delinquent 2016 Per Capita Taxes was also submitted by Tax Collector Michael Zavacky.  Councilman Angelo Uliana made a motion to turn the list of 2016 delinquent Per Capita Taxes to Berkheimer for collection, seconded by Councilman Joseph LeDonne.  Unanimous by roll call vote. 

 

 

Property & Utilities:

                Zmoda informed Council that she has had an architect in to get a proposal for new offices where the police station used to be.

 

Community Outreach:

                Council was given information on Slate Belt Rising which is the first multi-municipal neighborhood partnership program launched in the state.  This program joins Portland, Pen Argyl, Wind Gap and Bangor in planning and implementing community revitalization initiatives over the next six (6) years.   The group is looking for volunteers to serve on committees.

 

Borough Manager's Report:

                Council was given copies of meeting materials of the Slate Belt COG Manager’s meeting, Northampton County Joint COG Meeting and the Borough’s employee meeting. 

 

                Zmoda informed Council that she has submitted a RACP Grant for the Fire Station.


Payment of Bills:

                The following bills were presented for payment:  General Fund, $23,458.58; Sewer, $52,533.20; State Fund, $9,678.62 and Reserve Money Market Fund, $17,618.69.  Councilman Charles Kandl Jr. made a motion to pay the bills as presented, seconded by Councilman Angelo Uliana.  Unanimous by roll call vote.   

 

Executive Session:

 

                Councilman Joseph LeDonne made a motion to go into Executive Session to discuss real estate and potential litigation as requested by Borough Solicitor Layman, seconded by Councilman Angelo Uliana. Unanimous by roll call vote.   Council went into Executive Session at 8:05 P. M. and reconvened at  8:20  P. M. 

 

 

Adjournment:

 

                Councilman Charles Kandl Jr made a motion to adjourn, seconded by Councilman Angelo Uliana.  Unanimous by voice vote.  Council adjourned at 8:21 P. M.
