Tuesday 3rd of January 2017 - Council Meeting Minutes

            Pen Argyl Borough Council held their Meeting for January on Tuesday, January 3, 2017

at 7:00 P. M. in the Fire Hall.

 

Pledge of Allegiance:

                Council President Michael Nasatka opened the Council Meeting with the Pledge of Allegiance.

 

Roll Call:

                Council Members present and responding to roll call were:  Michael Nasatka, Angelo Uliana, Joseph LeDonne, Charles Kandl Jr., Roberta Cowley, Dean Minnich and Robert O'Donnell.  Councilman Jan Surotchak was absent.

 

                Also present were Mayor Mikal Sabatine, Borough Solicitor Peter Layman, Borough Manager Robin Zmoda and Borough Secretary Dolores Savitz. 

 

Re-Appointments and Appointments:

                Councilman Angelo Uliana made a motion and seconded by Councilman Charles Kandl Jr. to make the following re-appointments and appointments:

 

                Robert O'Donnell - Planning Commission, five (5) year term, expires 12/31/21

                Dale Houck - Municipal Sewer Authority, five (5) year term, expires 12/31/21

                James Davey - Zoning Board, five (5) year term, expires 12/31/21

                Dean Parsons, Carl Meixsell Jr., Michael Marsh, Matthew Kolb and Grant Parsons - Bureau of Fire Prevention, yearly appointment

                John Cuono and Council - Vacancy Board, yearly appointment

                Keith Valentine, Sewage Enforcement Officer and James Kleinle as alternate, yearly appointment (Both are employed by Borough Engineer Barry Isett & Associates)

 

                Roll call was taken of the motion and all Council Members voted in favor of the motion, unanimous vote by roll call. 

 

Appointment of Borough Representatives:

                Councilman Joseph LeDonne made a motion and seconded by Councilman Angelo Uliana to make the following appointments of Borough Representatives:

 

                Regional Advisory Committee (RAC) - Michael Nasatka, Delegate and Dean Minnich, Alternate

                Municipal Conference Committee - Mikal Sabatine, Delegate and Michael Nasatka, Alternate

                Watershed Advisory Committee - (LVPC) - Michael Nasatka, Delegate and Dean Minnich, Alternate

                Northampton County Tax Collection Committee - Robin Zmoda, Delegate and Charles Kandl Jr., Alternate

                Slate Belt COG - Roberta Cowley, Delegate and Mikal Sabatine, Alternate

 

                Roll call was taken of the motion and all Council Members voted in favor of the motion, unanimous vote by roll call. 

 

Open Records Officer:

                Councilwoman Roberta Cowley made a motion to appoint Borough Secretary Dolores Savitz

as Open Records Officer, seconded by Councilman Charles Kandl Jr.  Unanimous by roll call vote.

 


 

Council Liaison to Borough Municipal Sewer Authority:

                Councilwoman Roberta Cowley made a motion to re-appoint Councilman Dean Minnich

as Council Liaison to the Borough Municipal Sewer Authority, seconded by Councilman Charles Kandl Jr.  Unanimous by roll call vote.

 

Setting of Council Meetings and Workshops for year 2017: 

                Councilman Robert O'Donnell made a motion to hold Council Meetings on the 1st Tuesday of every month at 7:00 P. M. and to hold Workshops on the last Tuesday of every month at 7:00 P. M. both Council Meetings and Workshops to be held in Council Chambers, seconded by Councilman Angelo Uliana.  Unanimous vote by roll call.

 

Resolution NO. 2017 - 01:                            

                Borough Manager Zmoda presented Resolution NO. 2017 - 01 pertaining to fixing fees for

applications and permits for the establishment, repair, alteration or abandonment of on-lot septic systems, pursuant to the provisions of Section 103.5 of the PA Sewage Facilities Act 35.  Councilman Angelo Uliana made a motion to accept and approve Resolution NO. 2017- 01 as presented, seconded by Councilman Dean Minnich.  Unanimous vote by roll call. 

 

Visitors:

 

                John Hambrose and Adrienne Fors, representatives from Waste Management, were present.  Hambrose invited Borough officials and the public to the information expos that are going to be held pertaining to Synagro Technologies Inc.  The information expos are being held to acquaint the community with their Slate Belt Heat Recovery Center project proposed for a parcel on the Grand Central Landfill property in Plainfield Township. Synagro Technologies Inc. proposes a sludge-processing plant to be converted into biosolids.     

 

                Information sessions to be held:  Monday, January 9th from 6 P. M. to 8 P. M. at Plainfield Township Fire Hall; Tuesday, January 10th from 2 P. M. to 4 P. M. and 6 P. M. to 8 P. M. at the Weona Park Community Center. 

 

                There was approximately twenty five (25) people present that were opposed to the Synagro project.

 

                The following people spoke that were opposed to the project:  Tom Lee, 14 B Street; Gene Rissmiller, 808 George Street; Andrew Freda, 118 W. Pennsylvania Avenue,; William Blasi, 110 W. Plainfield Avenue; Tom and Elisa Robles-Carlo, 306 S. Robinson Avenue and Sarah Stein, 846 George Street.  They were concerned with odors coming from the proposed plant, health concerns and property values. 

 

                Council President Nasatka stated that Borough Council has instructed the Borough Solicitor to keep Council abreast of any information and to attend any meetings regarding the project.  The Borough will continue to examine the documents provided and monitor any impact on the Borough and its residents.

 

                Council encouraged everyone to go to the expo meetings and let their voices heard.

 


Public Works Report:

 

                All Council Members were given a copy of Public Works Director Steven Bender's December report to review. 

 

                Estimates were received from Always On Time Doors, LLC, 1033 Marble Hill Road, Phillipsburg, NJ 08865 to replace the street garage door with a 26 gauge galvanized door with thermo pane windows at a cost of $2,195.00 and a 26 gauge galvanized door with single pane windows for $2,155.00.  Cost included installation.  Councilman Dean Minnich made a motion to accept the quote of $2,195.00 for the door with the thermo pane windows, seconded by Councilman Angelo Uliana.  Unanimous vote by roll call. 

 

Zoning Report:

 

                All Council Members were given a copy of Zoning/Codes Office's December report to review.

 

Police Report:

 

                Nothing to report.

 

Fire Chief's Report:

 

                Fire Chief Dean Parsons reported that the fire company received ten (10) calls for the month of December.  They spend 198 hours on drills and 258 hours on calls.

 

Minutes:

 

                Councilman Dean Minnich made a motion to approve the Minutes for Regular Council Meeting of Thursday, December 15, 2016, seconded by Councilman Angelo Uliana.  Unanimous vote by roll call. 

 

Correspondence:

 

                Council received correspondence thanking them for their yearly contribution from Blue Mountain Community Library and The Heritage Center.

 

                Families First are hosting a Snow Ball Dinner Dance on Saturday, January 21st at the Weona Park Recreation Center.

 

                Information was received on the Northampton County County-Wide Housing Rehabilitation Program which may be able to benefit low-income homeowners. 

 

                A Downstream Notification List was received from Waste Management. 

 

Mayor's Report:

 

                Mayor Mikal Sabatine thanked everyone for their help at the December 2nd Community Holiday Party.

 


Planning Commission:

                Nothing to report.

 

Solicitor's Report:

                Borough Solicitor Layman requested an executive session before Council adjourned to discuss potential litigation.

 

Sanitation, Solid Waste & Recycling:

                Council Members were given a copy of the Wastewater Treatment Plant December report and also the closing of the CD for the Authority.

 

Finance, Tax Exoneration, Insurance & Personnel:

                All Council Members were given a copy of the Treasury Report as prepared and submitted by Borough Manager/Treasurer Zmoda.  Councilman Angelo Uliana made a motion to accept the Treasury Report as prepared, seconded by Councilman Charles Kandl Jr.  Unanimous by roll call vote.

 

                An audit of the Borough's year 2015 Liquid Fuels Tax Fund was completed on September 15, 2016 by PennDot.  The fund balances were accurate. 

 

Property & Utilities:

                Nothing to report.

 

Community Outreach:

                Nothing to report.

 

Borough Manager's Report:

                Wind Gap/Suburban Ambulance response time reports were given to all Council Members. 

 

                Borough Manager Zmoda asked Council to get in touch with the local Senator and Representative to encourage them to support the Borough's LSA Grant application.

 

                Information was also given to Council Members on Pennsylvania State Association of Boroughs (PSAB) webinar training for January.

 

                Zmoda informed Council that she has jury duty on Monday, January 9th.

 

Payment of Bills:

                The following bills were presented for payment:  General Fund, $20,417.42;  Sewer,$50,925.41; State Fund, $2,609.51 and Reserve Money Market Fund, $169,445.18.  Councilman Robert O'Donnell made a motion to pay the bills as presented, seconded by Councilman Joseph LeDonne.  Unanimous by roll call vote.   

 

 

 


Executive Session:

 

                Councilman Dean Minnich made a motion to go into Executive Session to discuss potential litigation as requested by Borough Solicitor Layman, seconded by Councilwoman Roberta Cowley.  Unanimous by roll call vote.  Council went into Executive Session at 7:49 P. M. and reconvened at

8:26 P. M.  Borough Secretary Savitz left at 7:50 P. M. and the rest of the minutes were taken by Borough Manager Zmoda. 

 

Adjournment:

 

                Councilwoman Roberta Cowley made a motion to adjourn, seconded by Councilman Dean Minnich.  Unanimous by voice vote.  Council adjourned at 8:27 P. M.
