Tuesday 13th of June 2017 - Borough Council Meeting

        Pen Argyl Borough Council held their Meeting for June on Tuesday, June 13, 2017 at 7:00 P. M. in the Fire Hall.  Special Note:  The Council Meeting had been rescheduled from Tuesday, June 6, 2017 due to lack of a quorum.

 

Pledge of Allegiance:

 

            Council President Michael Nasatka opened the Council Meeting with the Pledge of Allegiance.

 

Roll Call:

 

            Council Members present and responding to roll call were:  Michael Nasatka, Angelo Uliana, Joseph LeDonne, Dean Minnich and Robert O'Donnell.  Council Members absent were: Janell Connolly, Charles Kandl Jr. and Roberta Cowley. 

 

            Also present were Mayor Mikal Sabatine, Borough Solicitor Peter Layman, Borough Manager Robin Zmoda and Borough Secretary Dolores Savitz.

 

Visitors:

 

            Stephen Reider, Slate Belt Rising Director, updated Council on some of their projects.

Some of the Borough's allocated funds for their community event will be used towards the Summer Sounds at the Park.  Further shrubs will be placed in planters thorough out the Borough, funding allocation is $2,500.00.  There are seven (7) locations for new shrubs.  Funding has to be closed out by the end of June for the planters and end of September for the community events. 

 

Public Works Report:

 

            All Council Members were given a copy of Public Works Director Steven Bender's May report to review.  Bender was present.

 

            The cost of the proposed salt shed should cost approximately $200,000.00 according to Borough Manager Zmoda.  Monroe County Local Share funding for $100,000.00, Community Investment Partnership Program funding if approved for $50,000.00 and the Borough's share for $50,000.00 should cover the cost of the construction of the salt shed. 

 

            The action plan for the renewal of the NPDES Permit was discussed.  The drainage issues throughout the Borough have to be identified; BMP locations and a public meeting has to be held in order to move forward. 

 

            A copy of the final draft version of the public survey for the Weona Park Master Site Development Plan was given to Council.

 


            Council discussed the possibility of prohibiting trucks on George Street.  Since George Street is a PennDot road as well a section of George Street is located in Plainfield Township. It was recommended that Borough Manager Zmoda contact PennDot as well as Plainfield Township prohibiting trucks on George Street.

 

            A quote has been received from Best Line Equipment, Allentown, PA  on the cost  of a Bobcat 5600.  The cost of the Bobcat is $67,643.48 plus $750.00 for a forklift attachment, total cost of $68,393.48.  Councilman Dean Minnich made a motion to purchase the Bobcat at the cost of $68,393.48, seconded by Councilman Joseph LeDonne.  Unanimous vote by roll call.

 

            Borough Manager Zmoda stated that the installation of a storm sewer system can't be added as a change order to the B Street project, it would have to be rebid.  Council tabled the discussion of storm sewer system until after executive session.

 

Zoning Report:

            All Council Members were given a copy of Zoning/Code Office's May report to review.

 

            A letter was received from LVPC pertaining to the proposed school for St. Elizabeth Church on N. Heller Avenue that the plan is consistent with the Comprehensive Plan, the Lehigh Valley.

 

            Borough Solicitor Layman has prepared the Subdivision and Land Development Improvements Installation, Maintenance and Security Agreement for St. Elizabeth Catholic Church's school.  However, with the execution of the Agreement they must furnish a standby irrevocable letter of credit or other security acceptable to the Borough and Borough Solicitor.

 

Police Report:

            Council Members were given copies of the SBRPD minutes for their meetings of 04/04/17 and 05/02/17; May incidents and May offenses report.

 

Fire Chief's Report:

            Fire Chief Parsons reported that the fire company received eight (8) calls for the month of May.  They spent 225 hours on calls and logged an additional 286 hours on drills.

 

            Councilman Robert O'Donnell made a motion to pass a resolution authorizing the transfer of the ownership of the 1985 International fire truck to Lookout Fire Company to facilitate the purchase of a 2006 GMC fully equipped command/support vehicle, seconded by Councilman Angelo Uliana.  Unanimous vote by roll call.


            Councilman Joseph LeDonne made a motion that the 2006 GMC fire truck be titled in the Borough's name, seconded by Councilman Angelo Uliana.  Unanimous by roll call vote.

 

Minutes:

            Councilman Dean Minnich made a motion to approve the Minutes for the Special Council Meeting of Tuesday, May 30, 2017, seconded by Councilman Robert O'Donnell.  Council Members voting in favor of the motion were:  Angelo Uliana, Joseph LeDonne, Dean Minnich and Robert O'Donnell.  Councilman Michael Nasatka voted abstained.  There being four (4) votes in favor of the motion and one (1) abstained vote the motion carried.

 

            Council was also given copies of minutes from Park Board Meeting of April 18, 2017 and COG Meeting of April 26, 2017. 

 

Correspondence:

            Dennis Hower, Teamster Local 773 President - Teamster Local 773 will be hosting their 2017 Joe Wieder Memorial Scholarship Gold Tournament on Sunday, July 30, 2017 at Wedgewood Golf Course.

 

Mayor's Report:

            Mayor Sabatine informed Council that the Slate Belt YMCA is going to have a 5K run on Saturday, September 2nd, during the Labor Day celebration.  Sabatine will have the YMCA send the outline route and request to the Borough.

 

Planning Commission:

            Nothing to report.

 

Solicitor's Report:

            Nothing to report.

 

Sanitation, Solid Waste & Recycling:

            Council was given a copy of the Wastewater Treatment Plant's May report.

 

            Also given to Council were copies of the June 1, 2017 Engineer Report and the Municipal Sewer Authority Minutes from their meeting of May 1, 2017.

 

            Council was given a copy of the Bond Closings of the 2012 and 2013 Bonds.


Finance, Tax Exoneration, Insurance & Personnel:

            All Council Members were given a copy of the Treasury Report as prepared and submitted by Borough Manager/Treasurer Zmoda.  Councilman Dean Minnich made a motion to accept the Treasury Report as prepared, seconded by Councilman Robert O'Donnell.  Unanimous vote by roll call.

 

            Borough Manager Zmoda informed Council that the Reserve Fund C.D. has matured and has to be reinvested.  Councilman Joseph LeDonne made a motion to authorize Borough Manager Zmoda to reinvest the Reserve Fund C.D., seconded by Councilman Angelo Uliana.  Unanimous vote by roll call.           

 

            Councilman Robert O'Donnell made a motion to reschedule the July Council Meeting from Tuesday, July 4, 2017 due to the holiday to Tuesday, July 11, 2017, seconded by Councilman Dean Minnich.  Unanimous by roll call vote.

 

            Borough Manager Zmoda informed Council that she recently had a meeting with ESSA Bank to discuss the Borough's banking needs.

 

Property & Utilities:

            Three (3) quotes have been received for annual maintenance on generators for four (4) Borough locations.  Locations being:  (1) Blue Valley Acres Pumping Station, (2) Borough Hall, (3) Wastewater Treatment Plant and (4) West End Pumping Station.  Quote received as follows: (1) Emergency Systems Service Company annual price of $3,595.00; (2) Crowder Jr. Company for $2,590.00 and (3) Engines Inc. for $2,595.00. Councilman Dean Minnich made a motion to award the quote to Crowder Jr. Company for the annual price of $2,590.00, seconded by Councilman Robert O'Donnell.  Council Members voting in favor of the motion were:  Michael Nasatka, Angelo Uliana, Dean Minnich and Robert O'Donnell.  Councilman Joseph LeDonne voted no.  There being four (4) yes votes and one (1) no vote the motion carried.

 

Community Outreach:

            Borough Manager Zmoda informed Council that Slate Belt Rising is in the process of trying to apply for a CIPP Grant for $10,000.00.  They are asking the communities to help offset the match with the grant amount which would help to make a stronger application.  Council didn't take any action on the request. 

 

Borough Manager's Report:

            Borough Manager Zmoda informed Council that she had attended  a meeting with Waste Management on May 18, 2017 that the landfill had applied for a permit modification

to accept liquid and semi solid waste so it then could be solidified and dumped into the landfill.   

The estimated remaining life of the landfill capacity is 7.2 years.  Adrienne Fors, Grand Central Landfill Community Relations, was present. 

 

            Zmoda also attended a Northern Tier Trail Meeting.  The purpose of the meeting was to restate the primary objectives and define the study area. 

 

Payment of Bills:

            The following bills were presented for payment:  General Fund, $37,594.38; Sewer Fund, $67,523.68; State Fund, $3,755.02 and Reserve Money Market Fund, $86,634.55.  Councilman Robert O'Donnell made a motion to pay the bills as presented, seconded by Councilman Dean Minnich.  Unanimous vote by roll call.

 

Executive Session:

            Councilman Dean Minnich made a motion to go into Executive Session for possible litigation, seconded by Councilman Joseph LeDonne.  Unanimous by roll call vote.  Council went into Executive Session at 8:12 P. M. and reconvened at 9:14 P. M.  Borough Secretary Savitz left at 8:13 P. M. and the rest of the minutes were taken by Borough Manager Zmoda.

 

Adjournment:

            Councilman Joseph LeDonne made a motion to adjourn, seconded by Councilman Dean Minnich.  Unanimous by voice vote.  Council Meeting adjourned at 9:15 P. M.
